AllDaMemes is a meme archive and community platform operated by Obsidian Cloud. We are committed to respecting intellectual property rights while recognizing the unique nature of meme culture, which thrives on creative expression, commentary, parody, and the transformative reuse of media.

This policy should be read in conjunction with our Terms of Service, DMCA Policy, and Community Guidelines.

The following intellectual property is owned exclusively by Obsidian Cloud and may not be used without prior written permission:

• Platform Software: The AllDaMemes website, mobile applications, APIs, backend systems, algorithms, and source code.
• Design System: The AllDaMemes user interface design, visual identity, color palette, typography, iconography, and layout designs.
• Brand Assets: The "AllDaMemes" name, logo, tagline ("Every Meme. Every Moment. All Da Culture."), and all related brand marks.
• AI Systems: Our proprietary AI classification pipelines, prompt engineering, model configurations, and workflow architectures.
• Curated Content: Editorially curated collections, featured content selections, and platform-generated compilations.
• Documentation: All platform documentation, help articles, and educational content created by Obsidian Cloud.

The AllDaMemes platform and its original content are protected by copyright, trademark, trade dress, patent, and other intellectual property laws of the United States and international treaties.

3.1 You Retain Your Rights

Users retain ownership of any intellectual property rights they hold in the content they upload to AllDaMemes ("User Content"). Uploading content to AllDaMemes does not transfer ownership of that content to Obsidian Cloud.

3.2 License Grant

By uploading content, you grant Obsidian Cloud a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service. The full terms of this license are described in Section 4 of our Terms of Service.

3.3 Responsibility for Content

You are solely responsible for ensuring that you have the rights to upload and share any content you submit to AllDaMemes. This includes:

• Original content you created.
• Content you have permission to use from the rights holder.
• Content that qualifies as fair use under applicable law.
• Content in the public domain.
• Content licensed under open licenses (e.g., Creative Commons) that permit the intended use.

If you upload content that you do not have the right to share, you may be subject to account action under our DMCA Policy and Terms of Service.

AllDaMemes recognizes that meme culture is a vital form of modern creative expression. Memes often involve the reuse of existing images, video clips, and other media in ways that add new meaning through humor, commentary, criticism, parody, and cultural dialogue.

4.1 Fair Use Doctrine

Under 17 U.S.C. § 107, the fair use of a copyrighted work for purposes such as criticism, comment, news reporting, teaching, scholarship, or research is not an infringement of copyright. Courts consider four factors when evaluating fair use:

1. Purpose and character of the use: Whether the use is transformative (adds new meaning, expression, or message) or merely copies the original. Non-commercial and educational uses tend to favor fair use.
2. Nature of the copyrighted work: Whether the original work is factual or creative. Uses of factual works are more likely to be fair.
3. Amount and substantiality used: How much of the original work is used in relation to the whole. Using less of the original generally favors fair use.
4. Effect on the market: Whether the use harms the potential market for the original work. Uses that do not substitute for the original tend to favor fair use.

4.2 Memes as Transformative Works

Many memes are transformative in nature. Adding text overlays, editing images for comedic or satirical effect, and repurposing media for social commentary are forms of creative expression that may qualify as fair use. However, fair use is a fact-specific determination and we cannot guarantee that any particular use qualifies.

4.3 Our Approach

When reviewing copyright claims, we take fair use into consideration. We do not automatically remove content that may qualify as fair use. However, we must comply with the DMCA's notice-and-takedown procedures. If your content is removed and you believe it qualifies as fair use, you may file a counter-notification as described in our DMCA Policy.

AllDaMemes uses artificial intelligence to generate metadata for uploaded content, including:

• Titles and descriptions
• Tags and categories
• Cultural context and sentiment analysis
• Template identification
• Safety classifications
• Text extraction (OCR)

5.1 Ownership of AI-Generated Metadata

AI-generated metadata is produced by Obsidian Cloud's proprietary AI pipelines and is owned by Obsidian Cloud. This metadata is associated with User Content to enhance discoverability and the user experience.

5.2 Accuracy Disclaimer

AI-generated metadata is produced automatically and may contain inaccuracies. Obsidian Cloud does not guarantee the accuracy, completeness, or appropriateness of AI-generated content. Users may request corrections by contacting us at contact@obsidiancloud.com.

6.1 Attribution

AllDaMemes encourages users to credit original creators whenever possible. Our AI pipeline attempts to identify the origin of uploaded content through reverse image search and metadata analysis. Attribution information, when available, is displayed alongside content.

6.2 Third-Party Trademarks

User Content may contain third-party trademarks, logos, or brand elements as part of memes and cultural commentary. The presence of such marks on AllDaMemes does not imply endorsement, sponsorship, or affiliation with the trademark owner. Third-party marks are used solely in the context of user-generated creative expression.

6.3 Open Source

AllDaMemes uses open-source software components in its platform. Attributions for open-source libraries are maintained in our project dependencies and are available upon request.

The following are trademarks or registered trademarks of Obsidian Cloud:

• "Every Meme. Every Moment. All Da Culture."
• "The Culture Archive"
• "Obsidian Cloud"

These marks may not be used in connection with any product or service that is not Obsidian Cloud's, in any manner that is likely to cause confusion among consumers, or in any manner that disparages or discredits Obsidian Cloud.

All other trademarks, service marks, trade names, and logos referenced on the Service are the property of their respective owners.

If you believe that content on AllDaMemes infringes your copyright, you have several options:

AllDaMemes does not currently offer content licensing to third parties. All content on the platform is for use within the Service as described in our Terms of Service.
